Development projects are often located on or adjacent to Indigenous territories with significant impacts on their lands, lives, and cultures. As such, Indigenous peoples require unique consideration within Environmental Assessment (EA) frameworks which should respect Indigenous and treaty rights, including international commitments (e.g. UN Declaration on the Rights of Indigenous Peoples) and court rulings related to: (1) Free, Prior, and Informed Consent (FPIC) for development proposed on Indigenous lands; and (2) the inclusion of Indigenous knowledge and perspectives in decision-making. This seminar course surveys recent developments in these areas and explores the potential of EA to contribute to reconciliation between Indigenous and non-Indigenous peoples in Canada (and elsewhere).
